Agreement to Terms
These Terms and Conditions (“Terms”) govern your access to and use of the website located at thekrissylist.com and kristinegasbarre.com, together with all related pages, newsletters, videos, feeds, and other content and services made available through it (collectively, the “Site”). The Site is owned and operated by Gasbarre Media LLC (“Gasbarre Media,” “we,” “us,” or “our”).
By accessing, browsing, viewing, subscribing to, or otherwise using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Site.

Educational Purpose Only — No Professional Advice
The Site is provided solely for general informational and educational purposes. Nothing on the Site is intended to be, and nothing on the Site should be construed as, medical, health, nutritional, pharmaceutical, veterinary, legal, regulatory, financial, or other professional advice, diagnosis, or treatment. No content on the Site is a substitute for consultation with a qualified professional who is familiar with your particular circumstances.
Your use of the Site does not create a physician-patient, attorney-client, consultant, advisory, or other professional relationship between you and Gasbarre Media or any of its members, officers, employees, contributors, or contractors. We do not recommend, endorse, or prescribe any specific test, product, procedure, treatment, opinion, provider, or other information that may be mentioned on the Site. You are solely responsible for evaluating the information on the Site and for any decisions or actions you take based on it.

Health, Medical, and Product Safety Disclaimer
If you have or suspect you have a medical condition, or if you have questions regarding a medication, medical device, surgical device, dietary supplement, or food product, you should promptly consult a licensed physician, pharmacist, or other qualified healthcare professional. Never disregard, delay, or discontinue professional medical advice or treatment because of something you have read, watched, or heard on the Site.
If you believe you are experiencing a medical emergency, call 911 or your local emergency number immediately. Do not rely on the Site in an emergency.
Adverse events, product-quality complaints, and suspected injuries relating to foods, drugs, medical devices, or supplements should be reported directly to the U.S. Food and Drug Administration (“FDA”) through MedWatch or the appropriate FDA reporting program, and to your healthcare provider. Gasbarre Media is not a reporting agent, intermediary, or representative for the FDA or any other governmental authority, and reporting information to us does not constitute a report to any agency.

Recall, FDA, and Government Content
A portion of the Site is devoted to summarizing, aggregating, reproducing, or linking to publicly available government information, including FDA food recalls, FDA daily updates and press announcements, drug recalls, recalls and safety communications concerning medical and surgical devices, and other public reports issued by federal, state, or local agencies (collectively, “Government Content”).
You acknowledge and agree that:
(a) Source and timing. Gasbarre Media reports Government Content only after the issuing agency has made that information publicly available. All timing of disclosure is controlled by the issuing agency and not by Gasbarre Media. We do not receive, and do not claim to receive, advance, embargoed, confidential, or non-public information.
(b) No completeness or currency guarantee. Government Content is published on the Site on an “as-available” basis. Recall classifications, product lists, lot numbers, distribution details, and agency findings are frequently revised, expanded, or withdrawn by the issuing agency after initial publication. We do not guarantee that any item on the Site reflects the most current version of an agency’s notice, and we are under no obligation to update, correct, or supplement any previously published item.
(c) Verify with the primary source. The official records of the FDA, the U.S. Department of Agriculture, the Consumer Product Safety Commission, and other agencies are the authoritative sources. Before making any purchasing, clinical, dietary, disposal, business, or other decision, you must independently verify the information against the issuing agency’s own publication.
(d) Summaries and commentary. Where we summarize, excerpt, paraphrase, or comment on Government Content, that summary or commentary reflects our editorial understanding and is not an official statement of any agency. Any opinion, analysis, or characterization on the Site is the opinion of the author and not of the FDA or any other governmental body.
(e) No affiliation or endorsement. Gasbarre Media is not affiliated with, endorsed by, sponsored by, licensed by, or acting on behalf of the FDA or any other government agency. References to agency names, logos, publications, or programs are made for identification and educational purposes only. Works of the United States government reproduced on the Site are generally not subject to copyright protection in the United States; our compilation, arrangement, headlines, summaries, and original commentary are protected as described in Section 8.
(f) No liability for reliance. Gasbarre Media has no involvement in, and accepts no responsibility for, the accuracy, completeness, classification, or consequences of any agency determination, recall, or report, nor for any action or inaction taken by any manufacturer, distributor, retailer, or agency in connection with it.

Eligibility and Permitted Users
The Site is intended for users who are at least 18 years of age, or the age of majority in their jurisdiction if higher. The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you are between 13 and 18, you may use the Site only with the involvement and consent of a parent or legal guardian. By using the Site, you represent that you meet these requirements and that your use of the Site does not violate any applicable law or regulation.
The Site is operated from the United States and is intended for use by residents of the United States. We make no representation that the Site or its content is appropriate, lawful, or available in any other jurisdiction. If you access the Site from outside the United States, you do so at your own risk and are responsible for compliance with your local laws.

Newsletter and Electronic Communications
By submitting your email address to subscribe to any newsletter, alert, or mailing list offered on the Site, you consent to receive recurring electronic communications from Gasbarre Media, which may include educational content, recall and regulatory summaries, editorial commentary, and promotional or affiliate content. You may unsubscribe at any time using the unsubscribe link contained in each message or by contacting us at the address in Section 24. Unsubscribing may not immediately stop messages already queued for delivery.
Newsletter content is subject to the same disclaimers as the rest of the Site, including Sections 2, 3, 4, 16, and 17. Newsletter content is provided for educational purposes only, may summarize agency information that has since been revised, and should not be relied upon as a complete or current record of any recall or regulatory action.
You agree that Gasbarre Media is not responsible for the non-delivery, delayed delivery, misdirection, spam-filtering, or interception of any electronic communication, or for any harm resulting from your reliance on a communication you did not receive.

Video, Audio, and Multimedia Content
The Site may host or embed video, audio, podcast, livestream, and other multimedia content produced by Gasbarre Media or by third parties. Such content is provided for general education and commentary. Statements made by hosts, guests, contributors, or interviewees are their own and do not necessarily reflect the views of Gasbarre Media, and the appearance of any person or product in such content is not an endorsement.
Multimedia content may be edited, condensed, or presented with commentary. Where video or audio addresses recalls, agency actions, or product safety, it reflects information available as of the date of recording and may be outdated when viewed. Embedded content served by third-party platforms is subject to those platforms’ own terms and privacy practices, over which we have no control.
You may view and share links to our multimedia content for personal, non-commercial purposes. You may not download, copy, re-upload, re-broadcast, excerpt, caption, dub, remix, or otherwise exploit our multimedia content without our prior written permission, except as expressly permitted by these Terms or by applicable law.

Intellectual Property
Except for Government Content and third-party materials, all content on the Site, including text, articles, summaries, headlines, editorial commentary, photographs, graphics, illustrations, logos, video, audio, page layout, design, and the selection, compilation, and arrangement of all content, is owned by Gasbarre Media LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, Gasbarre Media grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the Site and to print or download individual pages for your own personal, non-commercial, educational reference. All other rights are reserved. You may not reproduce, republish, distribute, sell, license, mirror, frame, scrape, data-mine, or create derivative works from any part of the Site, or use any content of the Site to train, fine-tune, or develop any machine-learning or artificial-intelligence model, without our prior express written consent.
“Gasbarre Media” and any associated names, logos, and taglines are trademarks or service marks of Gasbarre Media LLC. Third-party names and marks appearing on the Site are the property of their respective owners and are used for identification and editorial purposes only.

User Submissions, Comments, and Feedback
The Site may permit you to post comments, submit questions, tips, photographs, documents, or other materials (“User Submissions”). You retain ownership of your User Submissions. By submitting them, you grant Gasbarre Media a worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable license to use, reproduce, adapt, edit, publish, display, distribute, and create derivative works from your User Submission in any medium, in connection with the Site and our business, without compensation or attribution to you.
You represent and warrant that you own or otherwise control all rights to your User Submission; that it is accurate to the best of your knowledge; that it does not infringe any third party’s rights or violate any law; and that it does not include personal health information about any other identifiable individual, confidential business information you are not authorized to disclose, or any material that is defamatory, harassing, or unlawful
Gasbarre Media has no obligation to review, monitor, publish, retain, or respond to any User Submission, and may edit, refuse, remove, or delete any User Submission at any time, for any reason or no reason, without notice. We do not endorse or verify any User Submission, and User Submissions do not reflect the views of Gasbarre Media. Any feedback, suggestion, or idea you send us regarding the Site is provided on a non-confidential basis and may be used by us for any purpose without obligation to you.

Prohibited Uses
You agree not to: (a) use the Site for any unlawful purpose or in violation of these Terms; (b) misrepresent recall, safety, or agency information obtained from the Site, including by presenting outdated or superseded information as current; (c) present yourself as affiliated with, or authorized to speak for, Gasbarre Media, the FDA, or any government agency; (d) use the Site to defame, harass, threaten, or make unfounded allegations against any manufacturer, distributor, retailer, healthcare provider, or individual; (e) upload viruses, malware, or other harmful code; (f) use any robot, spider, scraper, crawler, or automated means to access, copy, or index the Site except as permitted by our robots.txt file; (g) attempt to gain unauthorized access to the Site, its servers, or any user account; (h) circumvent any security, access-control, rate-limiting, or paywall measure; (i) interfere with or disrupt the operation of the Site or the networks connected to it; or (j) collect or harvest personal information of other users.

Third-Party Links and Third-Party Content
The Site contains, and will continue to contain, hyperlinks to third-party websites, including government agency pages, manufacturer notices, news outlets, retailers, and merchant or marketplace listings. These links are provided for convenience and reference only. Gasbarre Media does not control, operate, review, endorse, or assume responsibility for any third-party website or its content, products, services, availability, accuracy, security, or privacy practices.
When you follow a link away from the Site, you leave the Site and these Terms no longer govern your activity. You should review the terms of use and privacy policy of every third-party site you visit. Your dealings with any third party — including any purchase, subscription, inquiry, or dispute — are solely between you and that third party, and Gasbarre Media is not a party to and has no liability arising out of any such dealing.

Advertising, Affiliate, and Sponsored Content
The Site may display advertising and may participate in affiliate marketing programs. This means Gasbarre Media may earn a commission or other compensation when you click a link or purchase a product through the Site, at no additional cost to you. We may also publish sponsored posts, paid placements, or content produced in collaboration with a brand. We intend to identify such material in accordance with the Federal Trade Commission’s Guides Concerning the Use of Endorsements and Testimonials in Advertising.
Compensation does not influence our reporting of recalls or other Government Content, and the presence of an advertisement or affiliate link is not an endorsement of the advertiser’s product or a representation that the product is safe, effective, or free from recall. We do not evaluate advertised products for safety or regulatory compliance.

Products, Orders, and E-Commerce
Gasbarre Media may make products or digital goods available for purchase through the Site, directly or through third-party merchants, marketplaces, or fulfillment partners. Where a purchase is fulfilled by a third party, that third party’s terms, pricing, shipping, warranty, return, and refund policies govern the transaction, and Gasbarre Media is not the seller.
For any purchase sold directly by Gasbarre Media: all descriptions, prices, and availability are subject to change without notice; we may limit quantities, correct pricing or typographical errors, and refuse or cancel any order, including after an order confirmation has been sent; and payment is processed by third-party payment processors whose terms apply. We do not store full payment card information.
You agree to provide accurate, current, and complete purchase and account information. Except as required by applicable law or as stated in a published return policy, all sales of digital products are final. Nothing sold or offered through the Site is intended to diagnose, treat, cure, or prevent any disease, and no statement about any product on the Site has been evaluated by the FDA.

Our collection and use of information is described in our Privacy Policy, available at https://www.thekrissylist.com/privacy-policy, which is incorporated into these Terms by reference. By using the Site you consent to the practices described in the Privacy Policy. -
Copyright Complaints (DMCA)
Gasbarre Media respects the intellectual property rights of others. If you believe that material on the Site infringes your copyright, please send a written notice to our designated agent at the address in Section 24 containing: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and its location on the Site; (d) your contact information; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
We will respond to properly submitted notices in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512, and may remove or disable access to the material and terminate the accounts of repeat infringers. You may submit a counter-notice as provided by the DMCA.

THE SITE AND ALL CONTENT, INCLUDING GOVERNMENT CONTENT, NEWSLETTERS, VIDEO AND AUDIO CONTENT, AND ANY PRODUCTS OR SERVICES OFFERED THROUGH THE SITE, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, GASBARRE MEDIA LLC DISCLAIMS ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, GASBARRE MEDIA MAKES NO WARRANTY OR REPRESENTATION THAT THE SITE WILL BE UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE, OR THAT ANY CONTENT — INCLUDING ANY RECALL NOTICE, AGENCY UPDATE, PRODUCT LIST, LOT NUMBER, CLASSIFICATION, OR SAFETY COMMUNICATION — IS ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR ANY PARTICULAR PURPOSE. YOU ASSUME ALL RISK ARISING FROM YOUR USE OF, OR RELIANCE ON, THE SITE AND ITS CONTENT.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GASBARRE MEDIA LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITE, ANY CONTENT ON THE SITE, ANY THIRD-PARTY WEBSITE OR PRODUCT, OR ANY ACTION OR DECISION YOU TAKE OR FAIL TO TAKE IN RELIANCE ON THE SITE, INCLUDING ANY RECALL, AGENCY REPORT, OR SAFETY INFORMATION PUBLISHED OR OMITTED.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where such limitation is prohibited by applicable law. Some jurisdictions do not allow the limitation of incidental or consequential damages, so some of the above may not apply to you.

Indemnification
You agree to defend, indemnify, and hold harmless Gasbarre Media LLC and its members, managers, officers, employees, contractors, contributors, licensors, and agents from and against any claim, demand, action, proceeding, loss, liability, damage, penalty, cost, or expense (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Site; (b) your breach of these Terms or of any applicable law; (c) any User Submission you provide; (d) your republication, redistribution, or characterization of any content obtained from the Site, including any recall or agency information; or (e) your infringement or misappropriation of any third party’s rights.

Changes to the Site and to These Terms
Gasbarre Media may modify, suspend, or discontinue any part of the Site, including any newsletter, video series, recall feed, or shopping feature, at any time, with or without notice. We may also revise these Terms at any time by posting the revised version on the Site and updating the “Last Updated” date. Material changes will take effect upon posting unless otherwise stated. Your continued use of the Site after the effective date constitutes acceptance of the revised Terms. You should review these Terms periodically.

Termination
We may suspend or terminate your access to the Site, in whole or in part, at any time and without notice, for any reason, including any suspected violation of these Terms. Upon termination, the license granted in Section 8 immediately ends. Sections 8, 9, 16, 17, 18, 21, 22, and 23 survive any termination.

Governing Law and Venue
These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to Section 22, you and Gasbarre Media agree that the state and federal courts located in Contra Costa County, California have exclusive jurisdiction and venue over any such dispute, and each party consents to personal jurisdiction in those courts and waives any objection based on inconvenient forum.

Dispute Resolution
Before initiating any formal proceeding, the parties agree to attempt in good faith to resolve the dispute informally by written notice to the other party describing the claim and the relief sought, followed by at least thirty (30) days for the parties to confer.
If the dispute is not resolved informally, the dispute will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Contra Costa County, California, with judgment on the award enforceable in any court of competent jurisdiction.
To the fullest extent permitted by law, all claims must be brought in the party’s individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding, and the parties waive any right to a jury trial. Either party may bring an individual claim in small-claims court. Any claim arising out of or relating to the Site or these Terms must be filed within one (1) year after the claim arose, or it is permanently barred, except where a longer period is required by applicable law.

General Provisions
These Terms, together with the Privacy Policy and any additional terms applicable to a specific feature or purchase, constitute the entire agreement between you and Gasbarre Media regarding the Site and supersede all prior understandings. If any provision is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them freely, including in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates any partnership, joint venture, employment, agency, or franchise relationship. Headings are for convenience only. Gasbarre Media is not liable for any failure or delay in performance caused by circumstances beyond its reasonable control. These Terms do not confer any third-party beneficiary rights.
